Start with the 8 October 2026 cutover

Put the first of four HC 584 effective dates on the compliance calendar: 8 October 2026, followed by 29 October 2026, 30 November 2026, and 9 December 2026. For the relevant HC 584 changes, applications made before 8 October 2026 are decided under the Immigration Rules that were in force on 7 October 2026. The first date is the one that changes the filing window.

Start with the application date, not the decision date. A submitted file may still be decided under the rule in force when it was made. An unfiled file may fall under the later rule. The workaround is a simple calendar: mark the dates, then run the checks that attach to each date.

The package arrives in stages. Each date changes what evidence you need, what permission you can rely on, and what refusal risk you should screen before you file.

Run the four-date calendar as one checklist

Keep a single list you can run in a meeting. The first four items are the calendar; the remaining items are the pre-filing screens.

  • Mark 8 October 2026 as the main cutover.
  • Mark 29 October 2026 as the second effective date.
  • Mark 30 November 2026 as the third effective date.
  • Mark 9 December 2026 as the fourth effective date.
  • Re-run right-to-work for any Skilled Worker recognised as a modern slavery victim, because HC 584 permits that worker to work for any employer for the remainder of current permission.
  • Sequence the fee-waiver request date against the application date, because the changes alter fee waiver request and biometric enrolment rules to deter abuse through repeated or varied applications.
  • Screen UK-based applicants for earlier bail or custody breaches, because HC 584's suitability rules can support refusal on that basis.
  • Confirm the excluded earned settlement reforms are not in the package: the proposed move from 5 years to 10 years for the baseline ILR route is not included.
  • Check the student maintenance change where a student file is in the same batch: student visa maintenance requirements rise from 30 November 2026 to match updated maintenance loan levels.

Use the calendar to answer which date controls the file. Use the screens to answer which check catches the problem before filing.

Record the application date that controls the file

Do not treat the effective date as the filing date. The effective date tells you which rule applies. The filing date tells you which rule applies to that file. Write the application date in the file note, whether the file is close to the boundary or not. The note lets the next reviewer see why the file was filed when it was.

Keep the note short. The date, the route, and the reason for the timing are enough. A held file should say it is being held for a later date. An early file should say it is being filed early to preserve the earlier rule. The note should answer the question: why did this file cross the line when it did?

Stop the file when a screen fails

The permission screen catches a change in who the worker may work for. Records that still show the original employer as the only permitted employer need a correction before the file is treated as clean. Compare the current permission to the employer on the application. A mismatch stops the file.

Waiver sequencing stops a request that looks routine but lands on the wrong side of the application date. A request tied to a later filing may no longer use the earlier date as the safe anchor. The order is what the reviewer will test. Unclear order means do not file.

History screening surfaces a past compliance issue that was not part of the original sponsorship. A record can sit in a criminal or immigration file and still matter to a later application. Ask for the last compliance record you reviewed. A file that cannot name it is not ready.

Funds checking flags a batch with mixed routes. A file in the same batch that needs a different funds standard changes the money the applicant must show under the later date. Confirm the figure in the file matches the route and the date. Correct any mismatch before filing.

Reform checking keeps you from building a case on a change that is not in the package. Where the timeline is part of the advice, check that the reform is actually included before you rely on it. The advice should match the package. Remove any advice that does not.

Run the list before the filing meeting, not after the draft is ready.
